    The health care reform bill clearly states that illegal immigrants don’t get benefits. That means, ebayer, YOU LIE!

    I do think he was wrong for heckling the president and should have at least waited to express his dissatisfaction at a later time.

    Although SEC. 246 of the bill states: Nothing in “this subtitle” shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States.

    Now in that subtitle is “TITLE III–SHARED RESPONSIBILITY” and “Subtitle A–Individual Responsibility”

    The loophole comes in Subtitle B of Title III, that is not bound by SEC. 246. It is this section that outlines employer responsibility for coverage where they must make coverage available, and can auto enroll employees in the health plan.

    It is through the employer coverage that an Illegal worker may be able to acquire coverage, as this section has no previsions for legal work status.

    Though that loop hole may be covered in a later version of the bill.

    One of the sections that bothers me is SEC 401 that taxes anyone who does not have “acceptable” coverage even if they cannot afford coverage, as you still must pay for coverage. But this section falls under the jurisdiction of SEC. 246 so illegal workers are not taxed for choosing to forgo insurance.

    Subtitle B of Title III is covered by SEC. 246. SEC. 152, under Subtitle B under Title III, reads:

    152. PROHIBITING DISCRIMINATION IN HEALTH CARE
    (a) IN GENERAL. – Except as otherwise explicitly permitted by this Act and by subsequent regulations consistent with this Act, all health care and related services (including insurance coverage and public health activities) covered by this Act shall be provided without regard to personal characteristics extraneous to the provision of high quality health care or related services.

    Note the part that reads “Except as otherwise explicitly permitted by this Act and by subsequent regulations consistent with this Act,”

    That means that if some part of the law sates that it’s illegal to give illegals insurance, then it’s legal to deny them.

    That’s just it. Throughout his speech, he emphasized working with congress to draft something that is thorough, complete and satisfies people on both sides of the aisle. The current draft does not explicitly say that it will provide benefits to illegals, however if some language needs some tightening up in order to close loopholes, they’ll do it.

    Obstructionists like Wilson are simply looking for some small detail they can exploit to attempt to squash the whole thing rather than work towards a solution.

    It was Obama who said himself in the speech: “If you misrepresent what’s in the plan, we will call you out.”

    I completely agree with the sentiment but Sen. Wilson behaved improperly. If he wants to yell accusations without following up with argumentation backed by data or reason then he should be part of the British Parliament where that sort of thing is more acceptable.

    I don’t see any polls there referring to either presidential or congressional approval ratings. Please tell me you don’t think preferred political affiliation is equivalent to approval.

    To respond more clearly, comparing congressional approval to presidential approval is inappropriate as they are different scales.

    Congressional approval is always lower than presidential approval. Congressional approval has been on a relatively steady decline since 9.11.2001, was at it’s lowest in 2008 (tied with 1992 at 18%), increased to 31% this year and has begun a decline again. It would not surprise me to see congressional approval dip to 1992/2008 levels again, but it has not yet.

    Obama’s current approval rating is 53%. His term average is 61%. I’ll throw you a bone and agree that Obama’s first term approval rating is below George W. Bush’s first term approval of 76%. George W. Bush’s outgoing approval rating was 21%.

    If you’re all TL;DR, the data says you’re wrong.

    Not the point I was aiming for. My point is at best tangential to yours. The Republicans are losing the voters that keep them in office. It looks like they are moving over to the Independents.

    That being said, I just wish the Centrists could get their voices heard. The only thing I seem to hear on the news is the Far Right or the Far Left’s point of view. If the trends in the first table continue we may see a viable third party candidate with in a decade.

    And another bone to pick: Bush’s first term had 9-11 which skewed his numbers upward. I wonder how well/poorly he would have done if it hadn’t happened. Or how Obama’s numbers would have been if it had happened on his watch.

    What Rep. Wilson said is true. Obama used to be a professor in Constitution Law and he knows that it is UNCONSTITUTION to bar people from public services even if they are illegal immigrants (the same reason that illegals have a “right” to use our public education system). Even if it is written in any health-care bill that illegal immigrants are barred from services Obama knows that it will not hold up it court. The people of California recently voted to bar illegal immigrants from using public services, but the people’s will was overturned by the federal judges because, to them, it was unconstitution. Obama being a bright person and supposely very knowledgable about the Constitution has to know this and yet made the statement anyway.

    I think (and hope, otherwise you’re wrong) you’re talking about access to emergency medical services, in which case it is unconstitutional for the federal government to make a law governing or restricting it because EMS is something states regulate (separation of powers and all that jazz).

    Also, in Plyer vs. Doe (1985) the California Supreme Court ruled children of illegal immigrants are citizens of birth and are protected under the 14th Amendment, meaning that public services cannot be withheld from them per the Privileges and Immunities Clause.

    Public services are for citizens only. Legally the children of illegal immigrants are citizens. EMS is a tricky issue with other complications unrelated to laws governing other public services.

    Prop 187 was approved in 1994, overturned in 1997, and the appeals process stopped in 1999. When you said recently I assumed you meant something at least within the past decade, my mistake.

    It was found unconstitutional because it was a state attempt to regulate a federal power, immigration, not because it barred illegal immigrants from public services.
