I believe this is actually a red-winged blackbird attacking a red-tailed hawk. Generally gangs of birds swarm hawks to drive them away, to protect themselves and their young. They have both if these birds where I am from back in Colorado, tho I have only seen small birds driving crows away. Hawks can usually do whatever the fuck they want.
